Helping Childhood Arrivals Secure Legal Status in America
Children who arrive in America in an undocumented manner have no control over what happens to them. Unfortunately, many of these children grew up and experienced a harsh reality — often including facing removal proceedings — because the law hasn’t always protected them. However, it’s now possible to request DACA status in order to remain in the country legally. At Hall Trial Lawyers, our Greenville DACA lawyers provide the legal help you need, and when the program isn’t an option for our clients, we can often find alternative routes to legal status.

What Is DACA?
If you arrived in the United States without authorization before reaching the age of 16, you may qualify for deferred action under the Deferred Action for Childhood Arrivals (DACA) program, pending a potential overturn of the July 16, 2021 court ruling that halted the program. Before that date, DACA provided temporary relief from deportation proceedings.
It’s important to note that while deferred action does not lead to a green card, it does grant you permission to reside, work, and study legally in the U.S. Don’t lose hope, as there may be alternative pathways to DACA available. A significant number of DACA applicants are eligible for statuses that offer more permanent benefits.
To determine your eligibility for such options, it’s essential to consult with one of our skilled attorneys. Only a licensed attorney can assess your circumstances and navigate the intricate U.S. immigration system on your behalf. If the July 16 Ruling Is Struck Down, Do I Qualify for DACA Benefits?
In addition to arriving in the U.S. before the age of 16, DACA recipients must fulfill other requirements. This includes entering the U.S. on or before June 15, 2007, maintaining continuous residence in the country since then, and being under the age of 31 on June 15, 2012, without lawful status at that time. Eligibility also entails being enrolled in school, holding a GED, graduating or completing high school, or having an honorable discharge from the U.S. Armed Forces or Coast Guard.
Crucially, applicants must have no felony convictions, serious misdemeanors, or three or more minor misdemeanors, and must not pose a threat to public safety or national security. Regardless of the outcome of the July 16, 2021 ruling, there may be alternative legal avenues with more favorable results. Schedule a consultation with one of our empathetic attorneys to explore potential options that are available to you.
What Are the Alternatives?
Do not lose hope in the face of legal challenges. Visit one of our skilled immigration lawyers to explore potential benefits you may be eligible for. Here are some qualifying scenarios: Dreamers seeking more enduring advantages. If you currently possess DACA status and secure advance parole, you can lawfully travel and gain entry into the U.S. If you then marry a U.S. citizen or have a child over 21, you can apply for lawful permanent status – a green card while residing in the U.S.
Similarly, a DACA holder who legally entered the U.S. and subsequently marries a U.S. citizen can also seek a green card. Even if your entry was unauthorized, there is still room for optimism. If you marry a U.S. citizen, you can pursue a provisional waiver. Upon USCIS approval, you can travel and apply for (and receive) a green card via a U.S. consulate abroad, provided you meet the criteria. Given the ever-changing landscape of immigration laws, consulting one of our attorneys is crucial to explore any potential avenues for which you may qualify.
